NAHB Star! Rules and Procedures

Summary of Contest and Rules and Procedures [10/27/09]

Summary of Contest:  The NAHB Star! Contest (the “Contest”) is sponsored by the National Association of Home Builders (“NAHB”), in connection with its International Builders Show (“IBS”). Participants will sing a solo rendition of the National Anthem. Qualifying Contest entrants who meet all of the requirements will become Contestants.  The Contest will have two rounds. The first round of the Contest, including all voting, will take place exclusively online, on www.BuildersShow.com. The Top 3 Finalists, as a result of this voting, will advance to the final round, which will involve performing The Star-Spangled Banner live for a panel of judges in Las Vegas, Nevada.  The winner will then sing The Star-Spangled Banner live at the Opening Ceremony for the IBS in Las Vegas, Nevada in January, 2010.

Rules and Procedures

1. Individual Requirements.  The Contest is open only to individuals who are legal residents of the United States who are at least eighteen (18) years of age on the date the individual submits his/her entry to NAHB.

2. NAHB Affiliation Requirement. To be eligible to participate in this Contest, an individual must have an affiliation with NAHB at the time the entry is submitted and throughout the individual’s participation in the Contest. This affiliation can be satisfied if the entrant is a member of NAHB or if an immediate family member of the entrant is a member of NAHB. For this purpose, “immediate family member” is defined as a spouse, child, sibling, step sibling, grandchild, step child, step grandchild, parent, domestic partner, in-laws.  The qualifying NAHB membership must be in good standing throughout the participating individual’s involvement.

3. Contractual Requirements.  A Contestant may not have had a prior music recording contract. A Contestant also may not be a party to any of the following types of contractual agreements, or enter into any of the following types of contracts at any time from submission of entry through the Contestant’s involvement in the Contest:  music recording contract; contract for talent representation (for example, with a manager or agent); contract in connection with the use of Contestant’s name, voice and/or likeness; acting contract; or any other contractual arrangement which would limit or prohibit a Contestant’s full participation in the Contest, including the performance at the 2010 IBS Opening Ceremonies by the winner.

4. To Enter.  First read these Rules and Procedures carefully.  Each entrant must fully complete the official NAHB Star! Contest Entry Form/Release and submit the Entry Form/signed Release and video to NAHB IBS marketing for receipt no later than December 1, 2009. The Entry Form/signed Release must be sent via a fax to 202-266-8193 Attention NAHB Star Contest. Videos must be submitted online to nahbstar2010@gmail.com. The name of the entrant should be noted in the subject line of the email. Videos not sent via email will not be accepted. Entries received after December 1, 2009 will not be considered.  Each entrant may submit only one entry.  

5. Determination of Eligibility. NAHB will determine at its sole discretion whether an entry meets all requirements and whether the individual is eligible to be a Contestant.  All such decisions shall be final.

6. Performance Requirements.  Only video of a solo a cappella performance (without accompaniment) of the “Star-Spangled Banner” will be accepted. Any performance that includes more than one singer, any type of accompaniment or any song other than The Star-Spangled Banner will not be accepted. Contestants may not use props.  No individual other than the Contestant may appear in the video. Contestants should wear conservative attire, which should not include any logos or copyrighted material. Any performance that includes attire that in the sole discretion of NAHB is not appropriate, will not be accepted.

7. Video. All video submitted in connection with this Contest becomes the sole property of NAHB and will not be returned.  By entering this Contest, entrant understands and agrees that NAHB will own the video and may edit, adapt and/or use the video in any way NAHB may desire, including in connection with the Contest, the promotion of the Contest and/or the IBS, including, without limitation, for marketing and promotional purposes, and that there will be no compensation to entrant for any use by NAHB.

8. First Round. NAHB will post the Contestant videos on BuildersShow.com. All first round voting will take place exclusively online on BuildersShow.com. Only votes placed through the online voting process on BuildersShow.com will be counted, and any vote attempted to be cast through any other means will not be counted. 

First-round voting on the Contestant videos will take place from December 7 – December 18.

The Top 3 Finalists  will be announced  on BuildersShow.com on December 21, 2009 and will advance to the final round.

9. Final Round.  The Top 3 finalists must be available to be in Las Vegas, Nevada January 17-20, 2010 for the final round of the Contest on January 18, 2010 and must perform a live, a cappella solo of The Star-Spangled Banner for a panel of judges. The performance order shall be determined by random drawing. The judges will determine the winner, the first runner-up and the second runner-up. Decisions of the judges are final.

NAHB will arrange and pay for round-trip transportation for each of the three finalists and one (1) guest each to/from Las Vegas, Nevada and will provide each of the three finalists with three (3) nights hotel accommodation, consisting of one (1) standard room.  Each finalist will be fully responsible for all of his or her costs and those of their guest associated with the Las Vegas trip, including, but not limited to, food, entertainment, ground transportation and all incidental charges at the hotel.

10. Performance at IBS.  The winner will sing The Star-Spangled Banner at the Opening Ceremony for the IBS on January 19, 2010, and must participate in all rehearsals as required by NAHB, and follow all direction given by NAHB and all requirements for the performance.  In the event the winner is not available to participate in the Opening Ceremony or in any required rehearsal, at the sole discretion of NAHB, NAHB may disqualify the individual and instead utilize the first runner-up to sing at the Opening Ceremony, in which case, the preceding sentence shall apply to the first runner-up. If the first runner-up also is not available to participate in the Opening Ceremony or in any required rehearsal, at the sole discretion of NAHB, NAHB also may disqualify that individual and instead utilize the second runner-up to sing at the Opening Ceremony, in which case, the first sentence of this paragraph shall apply to the second runner-up.  

11. Ineligibility.  Employees and independent contractors of NAHB or of any of its subsidiary organizations, and their households and immediate families, and employees of IBS sponsors, are NOT eligible to participate in this Contest, even if they meet the other eligibility requirements.

12. General Conditions.  By submitting an entry, each entrant agrees to be bound by these Rules and Procedures, the decisions of NAHB, the judges and the voters, which shall be final and binding. A Contestant’s participation in the Contest, including the performance at the IBS, constitutes agreement to the recording and use by NAHB of the Contestant’s performance, appearance, name, voice, singing voice, likeness and any musical or sound effects produced by Contestant, for all purposes (including advertising, marketing, promotion, and the exploitation of any and all ancillary and subsidiary rights), as the same may be edited, in all media now known or hereafter created, throughout the universe, in perpetuity, for no compensation.

These Rules and Procedures may be changed at any time by NAHB.  NAHB reserves the right to cancel, suspend or modify the Contest or any element thereof, in any manner and for any reason.
