Preconstruction agreements are useful tools to manage the various phases of the residential construction process. However, they do present issues that parties should be aware of before entering into such agreements. This session addresses various types of preconstruction agreements, including lot reservations, design agreements, specifications and consulting agreements. It includes discussion of the provisions and use of such agreements, how they are integrated into the overall construction process, their pitfalls and also managing parties' expectations, administration and dispute resolution.
